Undeniable Moxie creates bold apparel with purpose, pride, and personality. We also believe policies should be clear, fair, and human.

These Terms of Service (“Terms”) apply when you visit our website, browse our store, or make a purchase through undeniablemoxie.com (the “Services”). By using our Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility & Use of Our Website

To use our Services, you must be at least the age of majority in your state of residence, or have permission from a parent or legal guardian.

You agree to use our website lawfully, respectfully, and in a way that does not harm our business, our customers, or other users.

2. Account Information & Checkout Details

When placing an order or creating an account, you may be asked to provide information such as your name, email address, billing details, shipping address, and payment information.

You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

3. Products & Availability

We currently offer apparel (i.e.: t-shirts) and may offer accessories including hoodies, hats, and other branded merchandise.

Many of our items are made to order through trusted third-party fulfillment partners. This allows us to reduce waste and create products intentionally.

Because of this process:

Product availability may change without notice
Some items may be discontinued
Production times may vary
Minor variations in color, placement, or print size may occur

We do our best to accurately display product colors and images, but screen settings may affect how colors appear.

4. Orders & Acceptance

When you place an order, you are making an offer to purchase. Your order is not officially accepted until payment is processed and we confirm the order.

We reserve the right to decline, cancel, limit, or refuse any order for reasons including:

Suspected fraud
Inaccurate billing or shipping information
Inventory or production limitations
Abuse of promotions
Violation of these Terms
Orders connected to harassment, hate activity, or misuse of our products or brand

If we need to cancel or modify an order, we will attempt to contact you using the information provided at checkout.

Please review your order carefully before submitting. Once production begins, changes or cancellations may not be possible.

5. Personal Use Only

Products sold through Undeniable Moxie are intended for personal or household use unless otherwise approved in writing.

You may not purchase items for unauthorized resale, export, or commercial redistribution.

6. Prices, Billing & Promotions

All prices are listed in U.S. Dollars (USD).

Prices, discounts, promotions, and product availability may change at any time without notice. The price charged will be the price shown at checkout when your order is placed.

Prices generally do not include taxes or shipping charges unless clearly stated. Applicable charges will appear during checkout.

You agree to provide valid and current payment information. By submitting payment, you represent that you are authorized to use the payment method provided.

If a pricing error or listing mistake occurs, we reserve the right to correct it, cancel the order, or contact you with available options.

7. Shipping

We currently ship only to addresses within the United States.

Estimated shipping times are not guarantees. Delivery may be affected by carrier delays, weather, holidays, address issues, or other circumstances outside our control.

8. Refunds, Replacements & Order Issues

Our Refund Policy explains how we handle damaged, defective, incorrect, or lost orders.

9. Intellectual Property & Brand Protection

Everything on this website—including our name, logos, slogans, product designs, graphics, text, photos, product descriptions, branding, and overall presentation—is owned by Undeniable Moxie or used with permission.

You may use the website for personal, non-commercial use only.

You may not copy, reproduce, modify, distribute, resell, scrape, republish, or commercially use any content from this site without prior written permission.

Unauthorized use of our designs, Pride messaging, branding, or original creative work may violate copyright, trademark, or other laws.

10. Reviews, Feedback & User Submissions

If you send us reviews, comments, photos, suggestions, testimonials, or other content (“Feedback”), you grant us permission to use, share, repost, edit, publish, and display that content for business purposes, including marketing and improving our Services.

You confirm that:

You own or have permission to share the content
Your content does not infringe anyone else’s rights
Your content is not unlawful, hateful, abusive, misleading, or harmful

We may remove content at our discretion.

11. Privacy

Your privacy matters to us. Personal information collected through our store is handled according to our Privacy Policy.

Because our website is powered by Shopify, certain information may also be processed by Shopify and related service providers to operate the store, process payments, improve performance, and complete your purchases.

12. Relationship with Shopify

Our online store is hosted by Shopify. Shopify provides the ecommerce platform that allows us to sell products and services to you.

However, purchases made through this store are transactions directly between you and Undeniable Moxie. Shopify is not responsible for our products, fulfillment decisions, customer service, refunds, or order disputes.

13. Prohibited Uses

You may not use our Services to:

Break any law or regulation
Commit fraud or provide false information
Harass, threaten, abuse, or target others
Infringe intellectual property rights
Spread malware or harmful code
Spam, phish, scrape, crawl, or harvest data
Use bots, automated tools, or AI agents to access the site without permission

Misuse our products or brand in hateful, discriminatory, or harmful ways

We reserve the right to suspend or block access if these Terms are violated.

If we do not enforce a provision immediately, that does not waive our right to enforce it later.

These Terms, along with our posted policies, represent the full agreement between you and Undeniable Moxie regarding use of our Services.

21. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may assign our rights or obligations as part of a business transfer or operational change.
